Terms & Conditions

These terms apply to all offers, orders and agreements with TenCate Art (Dutch Chamber of Commerce 97400394).

1. Identity of the seller

TenCate Art, Nederland. KvK 97400394, VAT NL868035968B01. Email: info@tencateart.com.

2. Offers and formation of contract

All works offered are unique. Offers are non-binding until a written confirmation is issued. Photographs, dimensions and descriptions are prepared with care; minor variations in colour or size may occur.

The contract is formed upon written confirmation by TenCate Art and/or successful payment via Stripe Checkout.

3. Prices and payment

All prices are in euro and inclusive of VAT. TenCate Art applies the EU margin scheme for works of art, antiques and collectors' items (Article 28b Dutch VAT Act / Articles 311–325 EU VAT Directive): VAT is calculated by the seller over the profit margin and is not shown separately on the invoice. The buyer cannot deduct this VAT as input tax.

Digital publications (e-books and other own publications) do not fall under the margin scheme. They are supplied subject to the Dutch reduced VAT rate of 9% for books (Table I, item a.30 Dutch VAT Act 1968, which equates electronic books with printed books). Prices shown include this 9% VAT and the VAT amount is stated separately on the invoice. For supplies to consumers in other EU member states, VAT is reported by TenCate Art under the Dutch small-business/Union OSS rules as applicable; for business customers outside the Netherlands the reverse-charge mechanism may be applied on request against a valid VAT identification number, and for customers outside the EU no EU VAT is charged.

Shipping and insurance are not included in the price and are calculated separately.

Payment is made via Stripe (card, iDEAL, SEPA and other supported methods) or, by agreement, by advance bank transfer.

4. Shipping, packaging and risk

Worldwide shipping is insured through specialist carriers. For door-to-door art transport within the Benelux, France, Germany and Italy we work with Easy2Send, a specialist art transport company.

Each work is packed with new, professional packaging materials suited to its fragility, size and value. Where possible we reuse packaging materials, provided they meet our quality criteria for protection and presentation.

Risk of damage or loss passes to the buyer upon delivery. International shipments may attract import duties or taxes in the country of destination; these are payable by the buyer.

5. Right of withdrawal and exclusions

Every purchase is binding. Consumers in the EU buying at a distance (through this webshop) have the statutory right to withdraw from the contract within 14 days of receiving the work, without giving a reason. This cooling-off period is mandatory law and cannot be shortened by us.

The right of withdrawal is excluded for custom work and products adapted at the buyer's request, such as works that have been framed, restored or otherwise modified for the buyer. Business buyers, dealers, institutions and other non-consumers cannot rely on the right of withdrawal.

The buyer is fully responsible for the object while it is in their possession, as well as for the choice and cost of the shipping method, adequate packaging and adequate insurance. Damage caused to the object during return shipping due to insufficient packaging or negligence will be charged.

To withdraw, send an unequivocal statement within those 14 days to info@tencateart.com (you may use the European model withdrawal form, but this is not obligatory). Please state your name, order number and the work concerned.

After notifying us, return the work within 14 days, insured, in original condition and in its original or equivalent professional packaging. The direct cost of return shipping is borne by the buyer; for large or fragile works we strongly recommend a specialist art carrier. Diminished value caused by careless handling or inadequate packaging may be deducted.

The purchase price and standard shipping costs are refunded within 14 days of the withdrawal notice, using the same payment method. We may withhold the refund until the work has been received back and inspected.

The right of withdrawal does not apply to: works acquired at auction or public sale, works adapted or made to the buyer's specification (frame, base, restoration, commissioned expertise), and purchases by business buyers, dealers, institutions and other non-consumers. Sales on location or at fairs carry no statutory cooling-off period.

Buyers outside the EU/EEA cannot rely on the European right of withdrawal. In such cases only the return arrangement agreed in writing between the parties applies.

Regardless of the above, the statutory right to a conforming item (Article 7:17 Dutch Civil Code) remains fully in force: if a work materially differs from its description, the buyer is entitled to repair, replacement, price reduction or rescission.

6. Authenticity, attribution and condition

Attributions ('attributed to', 'circle of', 'after', 'school of') follow standard art-historical conventions. Dating and provenance are stated to the best of our knowledge.

Condition reports are available on request and form an integral part of the contract.

7. Anti-money-laundering (Wwft)

For transactions of €10,000 or more, TenCate Art as an art dealer is obliged to verify the buyer's identity and to report unusual transactions to FIU-Netherlands.

8. Liability

Liability is limited to the invoice amount of the work in question, save in the case of intent or wilful recklessness.

9. Governing law and disputes

Dutch law applies. Disputes are submitted exclusively to the competent court in the Netherlands. Consumers may also use the EU ODR platform (ec.europa.eu/odr).

10. Intermediary & consignment services

The following provisions apply in addition whenever TenCate Art acts as an independent intermediary in the purchase and sale of works of art for clients (advice, assessment, placement or sale-related services).

Services. TenCate Art acts solely as an independent intermediary and never takes ownership of objects. Our role is limited to advising, researching, cataloguing and placing works of art with suitable auction houses or buyers.

Intake, travel and assessment fees. For on-site visits within the Benelux a fixed base fee of € 350 (excl. VAT) applies, plus travel costs from our location to the client's address at € 0.35 per kilometre. We do not work with hourly rates; this fixed fee covers travel time, inspection, initial research, categorisation and strategic advice during the visit. If the client proceeds with a consignment or intermediary agreement, TenCate Art may at its sole discretion offset (part of) the intake fees against the final commission. If the client decides not to proceed after the assessment, the intake and travel fees remain fully payable.

Commission structure. The standard commission is 25% on works successfully sold via channels selected by TenCate Art (such as Catawiki or comparable online platforms). For higher-value objects sold via international auction houses a different commission rate may apply. The commission is calculated on the net hammer price or the final sale price as received from the auction house or the buyer.

No guarantee of sale or price. All valuations, estimates and recommendations are advisory only. We do not guarantee sale results, hammer prices or acceptance of objects by auction houses.

No liability for objects. As TenCate Art never takes possession of works of art, we accept no responsibility or liability for loss, theft, damage or deterioration of objects held by the client, during transport, or at an auction house or third party.

Transport and handling. Transport is the responsibility of the owner or the auction house and is carried out by third parties. TenCate Art accepts no liability for issues arising from transport or handling.

Research and documentation. Catalogue information, condition observations and provenance summaries are provided on the basis of available information and professional judgement; they do not constitute formal authentication, certification or legal warranty.

Client obligations. The client provides accurate information on ownership and provenance, warrants that the works are free of claims, and grants TenCate Art access to inspect the objects when required.

Cancellation. The client may end the engagement at any time prior to consignment. Research already performed, intake work and travel costs incurred will be invoiced.

Acceptance of terms. By making use of TenCate Art's intermediary services — orally, in writing, or by permitting an assessment — the client acknowledges having read and accepted these terms.

11. Complaints, warranty and dispute resolution

Complaints about a work, the delivery or our services should be reported as soon as possible, and in any case within 14 days of discovery, by email to info@tencateart.com, including a description and, where possible, clear photographs.

We confirm receipt of your complaint within 5 working days and aim to provide a substantive response within 14 days. Where further investigation is required (for example a condition assessment or consultation with a carrier), we will inform you of the expected timeline.

Transport damage must be reported within 48 hours of receipt, with photographs of both the packaging and the work, so that the insurance claim can be filed in time.

A complaint does not suspend the payment obligation unless agreed otherwise in writing. If we cannot reach a solution together, consumers may bring the dispute before the competent Dutch court or use the European ODR platform (ec.europa.eu/odr).

12. Privacy and cookies

Personal data are processed only as described in our privacy statement, in accordance with the GDPR.

This website sets no tracking or advertising cookies. We use strictly necessary technical storage only (such as language preference and cart/checkout) plus anonymous page statistics without IP storage; under Dutch and EU law this requires no cookie banner or prior consent. 13. Intellectual property

All content on this website — including texts, catalogue descriptions, provenance information, research dossiers, images, photography, logos, branding and personal names — is owned by TenCate Art or used under licence. It may not be copied, reproduced, distributed, published, translated, modified or otherwise used in whole or in part without prior written permission from TenCate Art.

This applies in particular to the unique research texts, historical names and events identified and documented by the gallery. Use of information from this website for commercial, journalistic, academic or publicity purposes is permitted only with written permission.

14. Filming, photography and reproduction

Photographing, filming or otherwise reproducing objects, images or texts on the website, in the gallery or on location is permitted only with written permission from TenCate Art.

Systematically copying, screening, scraping or downloading the entire website or parts of it — for example by filmmakers, journalists, researchers or third parties — without prior agreement or purchase is not permitted. Visiting the website or gallery does not justify unrestricted use of the content.

15. Digital publications (books and e-books)

TenCate Art is an art dealer and gallery, not a publishing house, and we are not professional authors. Our own publications are conceived, researched, directed and edited by us, and the narrative text is written with the help of artificial intelligence. This is expressly disclosed on the product concerned.

Nature of the work. Novels and narrative publications by TenCate Art are works of fiction. They are inspired by historical documents in our own collection; scenes, dialogue, characters and events are partly filled in or invented. The texts are neither intended nor suitable as a historical, genealogical or academic source. Any resemblance to living persons is unintended. We give no warranty as to historical accuracy, style or completeness.

Delivery. Digital publications are delivered as a file (PDF) through a personal download link sent by e-mail, normally within a few hours and in any case within 24 hours of payment. Nothing is shipped physically and no shipping costs apply.

Right of withdrawal. By placing the order the buyer expressly consents to delivery of the digital content beginning immediately and acknowledges thereby losing the right of withdrawal once the file has been delivered (Article 6:230p(g) Dutch Civil Code). No refunds are given after delivery, except where the file is technically unusable, in which case we supply a working file free of charge.

Licence. The buyer receives a personal, non-transferable licence to read the work for private use. Resale, redistribution, publication, reproduction, translation, adaptation, filming, or use of the text to train AI models is not permitted without prior written permission from TenCate Art. Copyright and exploitation rights in the text, cover and design remain with TenCate Art.
